Terms of Business
Please read these terms carefully. They govern access to the MarineDirect marketplace and related services.
About these terms
These Terms of Business (“Terms”) govern your access to and use of the MarineDirect platform, operated by SEA LINE d.o.o., a company registered in Slovenia (“MarineDirect”, “we”, “us”). By accessing the website, creating an account, or publishing a listing, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
Definitions
“Platform” means the MarineDirect website and related services. “User” means any visitor, buyer, seller, or renter. “Listing” means any advertisement for a boat, charter, or related service. “Content” means any text, image, or data submitted to the Platform.
Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Platform. You are responsible for keeping your account credentials secure and for all activity under your account, and for providing accurate information and keeping it up to date.
Listings and user content
You are responsible for the accuracy, legality, and completeness of your listings and content. You grant MarineDirect a non-exclusive licence to host, display, and promote your content on the Platform. We may edit, refuse, or remove any content that is misleading, unlawful, infringing, or in breach of these Terms.
The marketplace and transactions between users
MarineDirect is an online marketplace that connects buyers, sellers, and renters and, unless expressly stated, is not a party to any sale, charter, or rental agreement and acts only as an intermediary. Price, payment, inspection, delivery, transfer of title, and legal compliance are agreed and carried out directly between the users involved. We do not guarantee the quality, safety, legality, or availability of any boat or service listed.
Payments and fees
Basic listings may be free or subject to the plans shown on the Platform. Featured, VIP, promotional, subscription, or dealer services may be subject to fees stated at the point of purchase. Where payments are processed, they are handled by third-party payment providers, and by paying you also accept their terms. Fees are stated in euros (EUR) and include or exclude VAT as indicated. Unless required by law or stated otherwise, service fees and paid placements are non-refundable once the service has started.
Promotions and featured placements
Featured, VIP, and promotional placements are offered at our discretion and may be subject to availability, approval, and editorial guidelines. We may decline or remove a promoted listing that does not meet our standards, with no obligation to refund where the listing breaches these Terms.
Cancellations and refunds
Consumers in the EU may have a statutory right of withdrawal for certain digital services; where it applies, it will be presented before purchase. Except where the law grants a non-waivable right, fees for services already performed or placements already published are non-refundable. Billing questions can be sent to our contact address.
Acceptable use
You must not misuse the Platform. In particular you must not attempt unauthorised access; scrape, harvest, or copy data without permission; upload malware; impersonate others; post unlawful, fraudulent, or infringing content; harass other users; or send spam or unsolicited communications.
Intellectual property
The Platform, its design, software, trademarks, and content (excluding user content) are owned by or licensed to MarineDirect and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
Data protection and privacy
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Slovenian law, as described in our Privacy Policy. By using the Platform you acknowledge that processing, and you are responsible for handling any personal data you receive from other users lawfully.
Disclaimers and limitation of liability
The Platform is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, MarineDirect is not liable for indirect, incidental, or consequential losses, lost profits, or losses arising from user content, third-party conduct, downtime, or transactions concluded between users. Nothing in these Terms excludes liability that cannot be excluded under mandatory law, including for death or personal injury caused by negligence, or for fraud.
Indemnity
You agree to indemnify and hold MarineDirect harmless from claims, damages, and costs (including reasonable legal fees) arising from your listings, content, breach of these Terms, or violation of any law or third-party rights.
Suspension and termination
We may suspend or terminate your access to the Platform, with or without notice, if you breach these Terms or where required by law. You may stop using the Platform at any time. Provisions that by their nature should survive termination (including liability, intellectual property, and governing law) continue to apply.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict-of-law rules. The courts of Slovenia have jurisdiction over any dispute, except where mandatory consumer law gives a consumer the right to bring proceedings in their country of residence.
Consumer rights and dispute resolution
If you are a consumer, you benefit from the mandatory protections of the law of your country of residence. Disputes may also be submitted to the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We aim to resolve complaints amicably, so please contact us first.
Changes to these terms
We may update these Terms from time to time. Material changes will be published on this page with an updated date. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
